Data Privacy Declaration

Protecting and keeping your privacy is a vital part of the product or services that we offer. When you apply for and use our services, this Privacy Declaration explains how we collect, store, protect, use, and disclose your personal information.

This declaration describes Haven Fund’s standard operating procedures with regard to the material and business activities that are made available through our network of websites, online and mobile applications, and social media pages (collectively, "websites").

The privacy policies for our customers who apply for and receive goods and services from us, including but not limited to business loans, auto loans, truck loans, and other similar goods and services that Haven Fund may occasionally offer, are likewise covered by this Declaration. The privacy policies outlined in this Decree are primarily designed for Filipino residents and are intended to adhere to the Data Privacy Act of 2012 (R.A. 10173) and the rules and regulations that go along with it.  Accessing our websites or use our services from outside the Philippines, you acknowledge and agree that your information may be transferred to and processed in the Philippines under legal and regulatory data protection standards that may differ from those in your current or home jurisdiction.

Collection of Data

We record your personal information when you apply for or use any product or service offered by Haven Fund, or when you communicate with our team members, authorized representatives, agents, and service providers. This may include, among other things:

  • your name and personal particulars such as contact information, address, date of birth, educational attainment;

  • specimen signatures;

  • government ID details;

  • financial information (such as income, expenses, balances, investments, tax, insurance, financial and transaction history, etc);

  • employment details;

  • business interests and assets;

  • images via CCTV and other similar recording devices and processes which may be observed when visiting our offices and/or using our other facilities;

  • voice recordings of our conversations with you


We may, as and when mandatory, request verification or supplement this information with third-party organizations, such as governmental regulators, judicial or supervisory bodies, tax authorities, or courts of competent jurisdiction, and in the course of doing so, learn more about you.

When you browse through our websites, we may offer you with data relating to the Haven Fund as well as information about our products and services. If you have signed up your account as a condition of usage, you can acquire an immediate access to your accounts through the website. We may record non-personal information such as the IP address, operating system, browser type and version, and other machine identifiers while you utilize our network of websites and electronic platforms. We may also employ web analytics technologies, including those provided by third parties, that use cookies to collect anonymous information and data created in connection with your engagements when you visit the pages and our network of websites.

We may also track, utilize, and retain personal perspectives or recommendations sent to us through feedback or input from surveys, as well as any other interaction you had with our team members, authorized representatives, agents, and service providers.

INFORMATION UTILIZATION

We utilize the information we collect from you to produce and provide the product or services that you’ve requested to:

  • process, support, carry out and approve applications and transactions;

  • acknowledge and reply to your questions, clarifications, complaints, requests and enhance our interactions with you;

  • send you statements, billings, notices, and other documentation required for the continuing use of our products and services;

  • conduct certain protections against unauthorized or abusive use of our products and services, including fraud prevention;

  • comply with the terms and conditions governing our products, services, facilities, our operational, audit, administrative, credit, and risk management processes, policies, and procedures, and channels, the rules and regulations of the Bangko Sentral ng Pilipinas, and legal and regulatory requirements of government regulators, judicial, supervisory bodies, tax authorities, or courts of competent jurisdiction, as amended or supplemented from time to time.

  • conform with applicable Philippine and foreign laws, including the US Foreign Account Tax Compliance Act (FATCA), anti-money laundering laws, including the provisions of Republic Act No. 9160 (Anti-Money Laundering Act of 2001, as amended (AMLA), and the implementation of know your customer and sanction screening checks

  • comply with legal and regulatory requirements such as data submission to credit bureaus, credit information companies, and the Credit Information Corporation (CIC) (in accordance with RA No. 9510 and its implementing rules and regulations), responding to court orders, and other instructions and requests from any local or foreign authorities including regulatory, governmental, tax, and law enforcement authorities, or other similar authorities;

  • execute other such activities permitted by law or with your approval.

CONSENTED INFORMATION DISCLOSURE

Under confidentiality agreements, we may share your personal information with our subsidiaries, affiliates, and third parties.

  • We might disclose data with our associates and companies, as well as other organizations, in order to provide you with new services and products that we think you may be interested in.

  • We can also employ third parties to assist us in administering our company's operations. These include assistance in:

    • observing legal requirements such as court orders

    • upholding our terms of service, which include, among other things, our rights as a creditor to customers who utilize our loan or credit products, or any other applicable policies with regard to the services that we provide;

    • addressing fraud, security, or technical issues, responding to an emergency, or otherwise protecting our customers' or third parties' rights, property, or security;

    • to carry out all other purposes set out above.

Furthermore, if you wish to acquire, or apply for registration as a client of any of our subsidiaries or partners, Haven Fund and the subsidiary/ies and/or partner/s associated may rely on, use, and share your necessary personal and/or account details for any of the following purposes:

  • To expedite your application with the relevant subsidiary/ies or affiliate/s;

  • To authenticate, consolidate, or update your customer information and/or credit history;

  • To offer consolidated billings, deposits, and other reports as requested;

  • To send you reminders, announcements, promotions, offers, invitations, and other notifications;

  • To add you to Haven Fund's and its affiliates' reward programs or other similar customer-focused initiatives;

  • To design financial, investment, or other related products or services for your use, or for research purposes;

    For marketing and/or promotional purposes for Haven Fund or the relevant subsidiaries or affiliates; and/or

  • To adhere to a legal requirement that Haven Fund or the relevant subsidiary(ies) or affiliate(s) is/are subject to.

We could transmit, retain, and/or manage your private information outside of the Philippines. In doing so, we will follow the Data Privacy Act and its corresponding regulations and laws.

We strive to ensure you that we do not and will not sell personal information to third parties. All of our transactions with third parties must be entirely in accordance with the confidentiality obligations placed on us by the governing agreements, terms and conditions, and/or laws that regulate our connection with you.

INFORMATION PRIVACY, RETENTION, & RIGHTS

We completely understand the importance of your personal information, especially when it includes sensitive personal information such as your gender, government-issued IDs, and so on. We use physical, technological, and procedural precautions to ensure the confidentiality, integrity, and availability of your personal information. We train our personnel to handle your information correctly. We require other organizations that offer services for us to protect personal information in accordance with our own security requirements.

We will be store and kept your personal information for as long as the purpose for which it was collected, as well as any other purposes to which you may have consented from time to time, is in effect, and until it is no longer required or necessary to keep your information for any other legal, regulatory, or business purposes.

In order to protect your privacy, you can opt to tell us:

  1. to refrain from sending you marketing materials through email or SMS;

  2. not to disclose your information with our subsidiaries and affiliates, or with other organizations with whom we do business, unless such information is critical or required by applicable laws and regulations in order to retain the services that you have requested from us;

  3. to give you with information that we currently hold about you, subject to the limitations imposed by certain laws and regulations on us as a company operating in the Philippines;

  4. to keep your information up to date;

  5. about any other issues you may have regarding how we collect, use, disclose, safeguard, or dispose of personal information.

We may charge a fee for processing your access and/or update request(s). The fee is determined by the nature and complexity of your request. Prior to making the request, you will be given information about the processing charge.

AMENDMENTS TO THE DATA POLICY DECLARATION

We maintain the right to modify or update this Data Privacy Declaration at any time in accordance with changes in applicable laws and regulations or how we collect, utilize, safeguard, store, disclose, or dispose of your personal information. Any relevant modifications will be made available on the Have Fund website.

Personal Information/Data - any information, whether recorded in a material form or not, from which the identity of an individual is obvious or can be reasonably and directly ascertained by the entity holding the information, or which, when combined with other information, would directly and certainly identify an individual.

Personal Information/Data Sensitive - refers to personal information:

  • Concerning a person's ethnicity, ethnic origin, marital status, age, color, and religious, philosophical, or political beliefs;

  • Concerning a person's health, education, genetic, or sexual life, or any proceeding for any offense done or alleged to have been committed by such person, the disposition of such proceedings, or the sentence of any court in such proceedings;

  • Issued by government agencies specific to an individual, such as social security numbers, prior or current health records, license denials, suspension or revocation, and tax reports; and

  • Specifically designated as classified by an executive order or a congressional legislation.
